Terms of Service

These Terms of Service ("Terms") govern your use of this website (xca.sh) and the official cloud-hosted service (dash.xca.sh). When you self-host the open-source Xcash software, it runs on infrastructure you control and is governed by its open-source license; the cloud-service sections of these Terms do not apply. By using the service you confirm that you have read and agree to these Terms, the Acceptable Use Policy, and the Privacy Policy.

Open-source software

Xcash is open-source under the MIT license and provided "as is," without warranties of any kind, express or implied. You may freely deploy, modify, and run it; you assume all responsibility for deployment, operations, key custody, and compliance arising from that use. The full license terms are set out in the LICENSE file in the code repository.

Official cloud-hosted service

The official cloud-hosted edition (dash.xca.sh) is operated by us and spares you from self-hosting. Using it requires an account, and you are responsible for keeping your credentials confidential and for all activity under your account. You must ensure the information you provide is accurate and comply with the Acceptable Use Policy.

Eligibility and geographic restrictions

To use the official cloud-hosted service, you must be at least 18 years old and have full legal capacity. In addition, given the regulatory requirements of the relevant jurisdictions, the service is not offered to U.S. citizens or residents, nor to users located in any sanctioned country or region (such as those on the OFAC and similar sanctions lists). By registering, you confirm that you are not among those excluded; if your circumstances change or your confirmation is untrue, we may suspend or terminate the service we provide to you.

Funds and non-custodial nature

Xcash collection operates through smart contracts whose fund destination is hard-wired to your own collection address; we do not hold, handle, or have the ability to move the crypto funds you collect. On-chain transactions are irreversible once made, and we cannot freeze, recover, or refund funds that have gone straight to your address. When using the cloud-hosted edition, the balance you prepay to cover platform fees is recorded by us on your behalf, subject to the billing terms below.

Billing and subscriptions

The cloud-hosted edition is billed by subscription for the plan you choose, and platform fees are deducted from your prepaid balance according to the published tiered fee schedule. Actual prices and rates are as shown on the website pricing page and in the dashboard. Except where required by applicable law, subscription fees and platform fees already incurred are non-refundable.

Availability and disclaimer

The cloud-hosted service is provided on an "as is" and "as available" basis. We make reasonable efforts to keep it stable but do not guarantee that it will be uninterrupted, error-free, or perfectly secure. Cryptocurrencies and blockchains carry inherent risks — price volatility, network congestion, smart-contract risk — which you must assess and assume yourself. To the maximum extent permitted by applicable law, we are not liable for any indirect, incidental, or consequential damages; and in no event will our aggregate liability for the cloud-hosted service exceed the total fees you paid us for that service in the 12 months preceding the event giving rise to the claim.

Indemnification

You will indemnify and hold us harmless against any third-party claims, regulatory or law-enforcement investigations, losses, or costs (including reasonable legal fees) arising from your breach of these Terms or the Acceptable Use Policy, your violation of law, or your misuse of the service for prohibited activities.

Suspension and termination

You may stop using the service and close your account at any time. If you violate these Terms or the Acceptable Use Policy, we may suspend or terminate the cloud-hosted service we provide to you. Because the service is non-custodial, termination only means we stop processing collections and providing related features for you; it does not affect funds that have already reached your collection address.

Intellectual property

The Xcash software is licensed under the MIT license, which grants you the corresponding rights to the source code. However, the "Xcash" name, logo, and trademarks, as well as the interface and copy of this website and the cloud-hosted service, remain the property of us or the respective rights holders, and may not be used without permission in ways that could cause confusion or imply affiliation.

Changes and governing law

We may update these Terms from time to time; when we do, we will revise the "Last updated" date at the top of this page and provide notice of material changes by reasonable means. These Terms, and the resolution of any dispute, are governed by the applicable law of the place where we actually operate.

Miscellaneous

These Terms, together with the Acceptable Use Policy and the Privacy Policy, constitute the entire agreement between you and us regarding the service. If any provision is held invalid or unenforceable, the remaining provisions remain in effect. Our failure or delay in exercising any right is not a waiver. You may not assign your rights or obligations under these Terms without our prior written consent; we may assign these Terms, for example in connection with a transfer of the business.
